This Privacy Policy explains our practices with respect to data we collect and process in connection with your relationship with us. This includes information we collect through, or in association with, our website with a home page located at www.poplar.money, together with all services we may offer from time to time via our website,mobile application, or otherwise through your interactions with us(collectively, the “Services”).

Please review the following to understand how weprocess and safeguard your data. By using any of our Services and/or byvoluntarily providing us with your data, you acknowledge that you have read andunderstand the practices contained in this Privacy Policy. This Privacy Policy may be revised from timeto time, so please ensure that you check this Privacy Policy periodically toremain fully informed.

2.     What Information Do We Collect?

We collect certain non public information about you (“Customer Data”)through the Services, including:

  • When you provide it to us directly by creating an account or subscribing to the Services;

Finally, we may collect data that is not identifiable to you or otherwise associated with you, such as aggregated data, and is not Customer Data. To the extent this data is stored or associated with Customer Data, it will be treated as Customer Data; otherwise,the data is not subject to this Privacy Policy.

Information You Share With Us. We collect Customer Data from you when you provide it to us, including through creating an account through the Services, undergoing a verification process in order to comply with financial regulations related to money transfers, connecting a bank account, or contacting us with questions or comments.  

For example, if you create an account to use the Services, we may collect your name, phone number, email address and company information. To proceed with the verification and on boarding process, we require that you provide additional personal data (including your date of birth, driver’s license or passport,proof of address, social security number, and employment information)sufficient to conduct a credit check and background screening.

Information Collected Automatically or Indirectly from You. When you browse or use the Services, we utilize commonly-used logging and analytics tools, including Google Analytics, to collect information about your use of the Services (such as how you navigate and move around the Services).

We also use cookies to personalize and enhance your experience with our Services,to collect data about your visit to our Services, to help diagnose problems with our servers, to administer the Services, and to gather broad demographic information about our users. 

Information collected automatically includes the software and hardware attributes of the device you use to access the Services, unique device ID information, regional and language settings, performance data about the Services, network provider, and IP address (a number assigned to your device when you use the Internet). In addition, information is collected passively in the form of log files that record website activity. For example,log file entries and analytics data are generated every time you visit a particular page on our website, and track the dates and times that you use the Services, the pages you visit, the amount of time spent on specific pages, and other similar usage information, and general data (including the name of the web page from which you entered our website).

Information Obtained from Third Parties. We receive Customer Data from third parties that we have engaged to provide services to us, such as payment processors, and other third parties from time to time.

3.     How Do We Process Customer Data?

Operational Uses. We process Customer Data as part of our operations, which include:

  • Providing you with information tailored to your requests, responding to inquiries, and delivering services and products;
  • Operating,maintaining, and improving the quality of the Services and such content,products and/or services as we may make available through the Services;
  • Communicating with you by email and text message (SMS, MMS), in each case with your consent,if such consent is required in accordance with applicable laws;
  • Debugging to identify and repair errors that impair existing intended functionality;
  • Undertaking internal research for technological development and demonstration;
  • Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity;
  • Compliance with applicable laws, regulations, rules and requests of relevant law enforcement and/or other governmental agencies, including Know Your Client and Anti-Money Laundering;
  • Endeavoring to protect our and our partners’ rights, property, or safety, and the rights,property, and safety of our users and other third parties; and
  • For other purposes, as permitted or required bylaw.

Sharing of Customer Data. Some of the above processing involves sharing Customer Data with third parties, including service providers and other partners

  • We share Customer Data with third parties when you authorize us to do so to effectuate transactions and provide the Services;
  • We share Customer Data with certain affiliated third parties;
  • We share Customer Data with our service providers, including our website developer, credit reporting agencies, banking and payment processors, and other vendors we engage so that they may provide services to us or on our behalf; and
  • We share Customer Data with government agencies or regulators when permitted or required to do so by law; in response to a request from a law enforcement agency or authority or any regulatory authority; and/or to protect the integrity of the Services or our interests, rights, property, or safety, and/or that of our users and others.

Accessing,Modifying, Rectifying, and Correcting Collected Customer Data. We strive to maintain the accuracy of any Customer Data collected from you, and will try to respond promptly to update our records when you tell us the information in our records is not correct. However, we must rely upon you to ensure that the information you provide to us is complete, accurate, and up-to-date, and to inform us of any changes. Please review all of your information carefully before submitting it to us, and update your account with any changes or corrections.

Depending on the laws that apply to you, you may obtain from us certain Customer Data in our records. If you wish to access, review, or make any changes to Customer Data you have provided to us through the Services, please contact us at the information provided at the end of this Privacy Policy. We reserve the right to deny access as permitted or required by applicable law.

5.    Protecting Customer Data

We use reasonable and appropriate physical, technical, and organizational safeguards designed to promote the security of our systems and protect the confidentiality, integrity,availability, and resilience of Customer Data. Those safeguards include: (i) the encryption of Customer Data where we deem appropriate; (ii) taking steps to ensure Customer Data is backed up and remains available in the event of a security incident; and (iii) periodic testing, assessment, and evaluation of the effectiveness of our safeguards.

However, no method of safeguarding information is completely secure. While we use measures designed to protect Customer Data, we cannot guarantee that our safeguards will be effective or sufficient. In addition, you should be aware that Internet data transmission is not always secure, and we cannot warrant that information you transmit utilizing the Services is or will be secure.

6.    Retention of Customer Data

We retain Customer Data as long as you are using the Services, and for six (6) years thereafter for compliance with applicable laws and regulations. In some circumstances, like cases of anti-money laundering or fraud, we may keep data longer if we need to and/or if required by law, or to the extent we reasonably deem necessary to protect our and our partners’ rights, property, or safety, and the rights, property, and safety of our users and other third parties.

7.    Your Choices

You have choices about certain information we collect about you, how we communicate with you, and how we process certain data. When you are asked to provide information, you may decline to do so; but if you choose not to provide information that is necessary to provide some of our Services, you may not be able to use those Services. In addition, it is possible to change your browser settings to block the automatic collection of certain information.

Communications Opt-Out. You may opt out of receiving communications from us at any time through a given communications channel by following the opt-out link or other unsubscribe instructions provided in any email message received, by contacting us as provided at the end of this Privacy Policy. If you wish to opt out by sending us an email to the address provided below, please include “Opt-Out” in the email’s subject line and include your name and the email address you used to sign up for communications in the body of the email.

Cookies and Web Tracking. It is possible to change your browser settings to block the automatic collection of certain information. Please note that disabling or removing cookies may prevent the Services, or certain functionality on the Services, from working correctly or at all.

8.     Other Important Information About Customer Data and the Services

Collection of Data from Persons Under 18. Persons under 18 years of age are not permitted to use the Services, and we do not knowingly collect information from persons under the age of 18. By using the Services, you represent that you are 18 years of age or older.

Business Transfer. We may, in the future, sell or otherwise transfer some or all of our business, operations or assets to a third party, whether by merger, acquisition or otherwise. Customer Data we obtain from or about you via the Services may be disclosed to any potential or actual third-party acquirers and may be among those assets transferred.

Former Clients. If you decide to close your account(s) or become an inactive customer, we will disconnect your account from any subscription activity, and will adhere to this Privacy Policy, which may be amended from time to time, in connection with Customer Data that we retain.

9.     Your California Privacy Rights:

This section applies to any California resident about whom we have collected personal information from any source, including through your use of our Website(s), by buying our products or services, or by communicating with us electronically, in paper correspondence,or in person (collectively, “you”).

For purposes of this section,“personal information” means information that Poplar maintains in a manner that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California consumer/resident or household. Personal information does not include publicly available information or information that has been de-identified or aggregated.

As a financial services provider to small businesses, much of our collected data is exempt from the California Consumer Privacy Act (“CCPA”), including under that law’s exemption for business-to-business data collection. However, because we are committed to transparency and the privacy of our customers, this Policy section contains details as to this exempt dataset in addition to any non-exempt personal information.

Please keep in mind, however, that our decision to provide you this information is done solely on a voluntary basis.   Poplar is not required to do sounder the CCPA or any other legal obligation. Therefore, Poplar reserves the right, in its sole discretion, to determine the amount and type of information we disclose to you in the future or how to respond to privacy requests that you may submit to us.

10.     Modificationsand Updates to this Privacy Policy

This Privacy Policy replaces all previous disclosures we may have provided to you about our information practices with respect to the Services. We reserve the right, at any time, to modify, alter, and/or update this Privacy Policy, and any such modifications, alterations, or updates will be effective upon our posting of the revised Privacy Policy. Your continued use of the Services following our posting of any revised Privacy Policy will constitute your acknowledgement of the amended Privacy Policy.

11.     Applicability of this Privacy Policy

This Privacy Policy is subject to any customer agreements, including, but not limited to, the Terms of Use that govern your use of the Services. This Privacy Policy applies regardless of the means used to access or provide information through the Services

This Privacy Policy does not apply to information from or about you collected by any third party services or websites linked from the Services, including Plaid Inc., which we use to gather Customer Data from financial institutions, and Prime Trust, our financial custodian partner. Any such collection or receipt of Customer Data is subject to Plaid’s privacy policy and terms of use , and/or Prime Trust’s privacy policy and terms of service, as applicable, and under no circumstances are we responsible or liable for any third party’s compliance therewith
